It argues that its rules required Opetaia to bring the case in New Jersey, where the IBF is based. The organization also claims he went to court without completing its mandatory internal appeal process. Opetaia has until September 8 to respond.
Those objections give the IBF a chance to attack the lawsuit without immediately defending the decision to remove Opetaia as cruiserweight champion. A ruling based on venue or internal appeal grounds would not establish that his accusations lack merit.
He may be allowed to refile in New Jersey or complete the IBF appeal procedure before returning to court. A dismissal with prejudice would cause far greater damage by preventing him from bringing the same claims again.
The $73,000 Sanctioning Fee
The complaint alleges that the IBF accepted Opetaia’s $73,000 sanctioning fee shortly before his March 8 fight with Brandon Glanton, then withdrew approval for the contest. The organization says the payment arrived March 6 and was returned the next day.
The timing is central to Opetaia’s claim under the Muhammad Ali Boxing Reform Act. His complaint accuses the IBF of accepting the money without making required disclosures to the Nevada State Athletic Commission.
The IBF says it withdrew sanction after learning that the Zuffa Boxing cruiserweight title would be awarded. Its rules recognize unifications involving only the IBF, WBA, WBC, and WBO.
His lawsuit argues that the refusal to recognize Zuffa’s title was part of coordinated action intended to punish him for joining a competing boxing operation. The accusation has not been proven, but it places the control exercised by boxing’s four established sanctioning bodies at the center of the case.
Mikaelian Risks His WBC Championship
Noel Mikaelian is now testing that control from another direction. The WBC ordered him to defend against David Benavidez, but Mikaelian accepted a September 12 fight with Opetaia instead.
Desai said Mikaelian is expected to be stripped, although the WBC has not issued a final ruling. The reason would be his failure to make the ordered Benavidez defense, not his participation in a Zuffa Boxing event.
His choice also shows the limits of sanctioning body authority. Opetaia remains The Ring champion and the leading cruiserweight despite losing the IBF belt. Mikaelian evidently considers facing him on the Ryan Garcia versus Conor Benn card valuable enough to risk his own championship.
The IBF and WBC can remove their belts. They cannot make Opetaia less formidable or prevent the division’s leading fighters from treating him as its central figure.
